SOCIAL MEDIA PHOTO CONTEST OFFICIAL RULES

This social media user generated content (“UGC”) photo contest promotion (hereinafter “Contest ”) is conducted by Casino Queen Marquette (hereinafter “CQM”). This Contest is subject to all applicable federal, state, and local laws and regulations, and it is void where prohibited by law.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OF ANY PRODUCT SOLD BY CQM DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This CQM Contest is open to legal residents of the fifty (50) United States and the District of Columbia who have reached the age of twenty-one (21) at the time of entry (hereinafter “Participants”). Individuals who are self-excluded are not eligible to participate or win. Employees, officers, directors, agents, and representatives of CQM, its parent company, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising & promotion agencies, and each such individual's immediate family members (mother, father, sister, brother, child, husband, wife, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win.
2. Agreement to Rules: By participating in the Contest, a Participant agrees to be fully and unconditionally bound by these rules, and each Participant represents and warrants that the Participant meets the eligibility requirements set forth herein. A Participant further agrees to accept the decisions of CQM as final and binding as it relates to the final results of this Contest promotion.
3. Contest Period: Entries will be accepted online starting September 1, 2024 at 5:00PM CST and ending September 30, 2024 at 11:59PM CST. All online entries must be received by September 30, 2024 at 11:59PM CST.
4. How to Enter: A Participant may enter the Contest by following a link on Facebook, Instagram and/or the X. The link will direct Participant to CQM’s Contest page where Participant may upload a photo depicting Pinky the Elephant (“Eligible Photo”). Specifically, CQM would like to see photos capturing Pinky and the surrounding scenery. Please note that if the photo Participant would like to submit depicts any person other than Participant, CQM may require a photo release from said person(s) before the photo may be considered in the Contest. The entry must also fulfill all other Contest requirements, as specified herein, to be eligible to win a prize. Entries that do not adhere to the rules or specifications may be disqualified at the sole discretion of CQM. A Participant may enter up to two (2) times and must provide the information requested. The Participant may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If a Participant uses fraudulent methods or otherwise attempts to circumvent the rules, the Participant’s submission may be removed from eligibility at the sole discretion of CQM.
5. Entry Requirements: (a) Participant may not have a hired photographer or other person to take the Eligible Photo for submission in the Contest. Participant must be the individual who took the Eligible Photo; (b) The Eligible Photo may not portray CQM or its products in a negative light or contain any content that is inappropriate or indecent, as determined by CQM in its sole discretion; (c) Everyone depicted in Participant’s Eligible Photo must be appropriately clothed; (d) The entry may not prominently feature any third-party trademarks, logos, or artwork nor may it violate anyone’s rights, including, but not limited to, copyrights or trademark rights; (e) Participant must have all rights and permissions to submit and share the Eligible Photo.
6. Prize Winner: 1st Place Winner will receive $100 in Royal Free Play. 2nd Place Winner will receive $75 in Royal Free Play. The 3rd Place winner will receive $50 in Royal Free Play. Winners will be announced on October 4th by 5pm CST. Guests will have 24 hours to claim their prize once notified via messenger. Winners will have until October 30th to come to Casino Queen Marquette with valid Drivers License or ID to receive their Royal Free Play. Royal Free Play will be valid for 3 days after issue date. No cash or other prize substitution shall be permitted except at CQM’s discretion.The prize is nontransferable. Any and all prize-related expenses, including without limitation, any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winners. Acceptance of prize constitutes permission for CQM to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law. Other than the details of the Prize as outlined above, CQM has no additional obligations or commitments to any Prize Winner in connection with this Contest.
7. Odds: The odds of winning depend on the number of eligible entries received.
8. Winner Selection and Notification: The top ten (10) Eligible Photos will be determined by a public vote. To vote, a user must click on the Contest link where the user will see an option to vote for a favorite photo. A user may only vote once. The photos with the most votes will then move onto the CQM Marketing Team judging round wherein the CQM Marketing Team will pick four (4) total Winners out of the top10 Eligible Photos received. Winners will be notified via email following selection. CQM shall have no liability for a Winner’s failure to receive notice due to Winner’s provision of incorrect or otherwise non-functioning contact information. If a Winner cannot be contacted, is ineligible, fails to claim the prize within forty-eight (48) hours from the time first contact was made, or fails to timely return a completed and executed declaration and release as may be required, the prize may be forfeited and an alternate Winner selected. Receipt by a Winner of the prize offered in this Contest is conditioned upon compliance with all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER(S) (AT CQM’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
9. CQM’s Rights to Eligible Photos/Entries: By entering this Contest, Participant represents and warrants that Participant’s Eligible Photo entry complies with all requirements of these Official Rules and Participant has the rights necessary to grant CQM the rights to Participant’s Eligible Photo as described herein. Participant does not transfer ownership of the Eligible Photo. However, by entering, Participant grants CQM, its licensees, successors and assigns, the right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly adapt, modify, create derivative works of, exhibit, and otherwise use the Eligible Photo as-is or as-edited (with or without using Participant’s name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from Participant. By entering the Contest, Participant further grants CQM, its licensees, successors and assigns, the right and permission to use Participant’s name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review and/or consent, unless required by law.
10. Terms & Conditions: CQM reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond CQM’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, CQM may select the Winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by CQM. CQM reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Official Rules. CQM has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to: more than the allowed number of entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws.
11. Limitation of Liability: By entering, Participant agrees to release and hold harmless CQM, its parent company, subsidiaries, affiliates, representatives, agents, successors, assigns, employees, officers, and directors from any and all liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether or not caused by negligence, from: (i) such entrant’s participation in the Contest and/or the Participant’s acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; or (v) electronic or human error in the administration of the Contest or the processing of entries.
12. Disputes: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Participant and CQM in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Louisiana without regard to its conflict of laws principles. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering the Contest promotion). Participant further waives all rights to have damages multiplied or increased.
13. Privacy Policy: To enter the Contest, a Participant must follow a link on Facebook, Instagram and/or the X. The link will direct Participant to CQM’s Contest page where the Participant may upload an Eligible Photo. If selected as a Winner, the Participant must provide the Participant’s legal name, date of birth, state of residence, email address and phone number. Information submitted with an entry is subject to the Privacy Policy stated on CQM’s website at https://casinoqueenmarquette.com/privacy-policy/.
14. Winner’s List: To obtain a copy of a Winner(s) name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Casino Queen Marquette [ATTN: Marketing], 100 Anti Monopoly, Marquette, Iowa, 52158. Requests must be received no later than September 30, 2024 at 5:00PM CST.

16. Social Media: The Contest is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram or X (Formerly known as Twitter).
17. By entering the Contest, Participant acknowledges that Participant has affirmatively reviewed, accepted, and agrees to all of the Official Rules.
